Waiver Rules and Regulations

Welcome to MOA Art Kids!
Please complete this registration form to begin booking classes. To view available courses, click the SCHEDULE button. No charges will be made to your credit card until you enroll in a class.

All students must complete the registration process, sign the waiver, and accept the Studio Rules and Procedures to enroll in courses at MOA Art Kids art studios.

Tuition Fees and Payment Schedules

Tuition fees and payment schedules will be outlined in the course schedule and are subject to change with prior notice.

Art Classes Registration

Registration for art classes is open year-round, allowing you to join at any time during the year.

Individual/Try-Out Classes
Our individual or try-out classes provide flexibility, allowing you to sign up at your convenience and attend classes based on your availability. The fee for each try-out class is $25.00 + HST per participant, which includes all materials provided by the studio. Payment for individual/try-out classes must be made in advance to secure your spot.

Regular Art Classes (Monthly Membership)
Regular art classes operate on a monthly membership basis. Payment must be made by the 1st day of each month to enroll. You can join the monthly membership at any time during the month, with your fee calculated based on the number of classes you’ll attend that month. Membership is flexible—you may opt out at the end of any month.

Students are allowed one credit for an excused absence per month. This credit can be used for a make-up class, which will be scheduled as a Homework Club class within the same month.

If you have special requests for private classes, special events, or accommodations, please contact us directly.

Specialized Workshops Registration

Participants are encouraged to sign up for Specialized Workshops in advance to secure their spot and allow time to gather the necessary materials or request their purchase from the studio.

Workshop Duration and Structure
Our workshops run year-round in 4- or 8-week blocks. Each block focuses on a specific subject, allowing for a progressive build-up of knowledge, skills, and in-depth study.

Missed Classes
Missed workshop classes are non-refundable. However, with 24-hour advance notice, students may receive a credit to be used during the Homework Club class.

Discounts

Families with siblings attending classes are eligible for a 5% discount. Please notify us via phone, email, or by indicating it on your registration form.

Note: Only one discount may be applied per registration. Discounts cannot be combined.

Materials:

To maintain affordability and provide flexibility of the art classes and workshops, the students are allowed to bring their own art supplies and materials for any of the classes and workshops. Those who prefer to purchase their supplies directly from the studio, we’ll make sure to provide you with the optimum and best solution on the market to allow best experience and results.

For our digital painting courses, the students are required to bring their personal laptop, drawing tablet with stylus/pen, computer mouse and a USB memory stick.

The materials for all PA Days and Camps are provided by the studio.

WAIVER OF CLAIMS AND RELEASE OF LIABILITY

In consideration of MOA Multimedia Arts and Architecture Inc., operating as MOA Art Kids art studios (the “Company”), permitting the individual named below to participate in MOA Art Kids art studio activities, and for other good and valuable consideration, I agree to all the terms and conditions set forth in this agreement (this “Agreement”).

As a parent and/or guardian, I affirm that I am authorized to execute this waiver of liability on behalf of both my minor child and myself. I understand that as a condition of participation in the MOA Art Kids program, I must agree to waive any legal claims against the Company. While I acknowledge that the Company strives to make its programs safe and enjoyable, I recognize that accidents may occur.

Accordingly, I hereby expressly waive and release any and all claims that I currently have or may have in the future against the Company, its affiliates, and their respective directors, officers, employees, agents, representatives, contractors, shareholders, successors, and assigns (collectively, the “Releasees”). This waiver applies to any injury, death, or property damage arising out of or attributable to my participation in the activities, whether caused by the negligence of the Company or any other Releasee, breach of contract, or breach of any statutory or other duty of care under applicable law.

I further covenant not to bring or pursue any such claim against the Company or any other Releasee and irrevocably release and discharge the Company and all other Releasees from liability related to such claims.

INDEMNIFICATION

I agree to defend, indemnify, and hold harmless the Company and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of any kind, including reasonable legal fees, arising out of or related to any third-party claim, suit, or action resulting from my participation in the activities.

EMERGENCIES
If your child requires any medication on-site (including an EpiPen or Benadryl), you must provide the necessary product to MOA Art Kids. I understand that participation in camp and other art activities involves inherent risks and the potential for accidents resulting in physical injury. Acknowledging these risks, I voluntarily assume them on behalf of my minor child.

Furthermore, I authorize the staff of MOA Art Kids to use their best judgment in any emergency situation and release the Company from liability for any injury sustained, including death, as a result of participation in the art activities.

In the event of an accident, injury, or illness involving the Registrant, if immediate contact with a designated emergency contact cannot be made, I hereby authorize and grant permission to MOA Art Kids’ staff or volunteers to secure appropriate medical treatment. This includes, but is not limited to, admission to an emergency unit or hospital, treatments, x-rays, tests, injections, anesthesia, and/or surgery, as deemed necessary by attending medical professionals.

I agree not to hold the Company, its staff, volunteers, directors, owners, or representatives responsible for any costs or injuries arising from an emergency situation. To ensure the safety and well-being of all participants, the Company reserves the right to alter the Program or withdraw any individual at any time without notice or compensation to the Registrant.

ALLERGIES
I acknowledge and understand that MOA Art Kids enforces a NO nut product policy for all participants and their families. I agree not to send my child with any food items containing nuts, nut by-products, or items produced in facilities that process nuts for consumption at MOA Art Kids’ site or events.

I understand that many children have peanut and other nut allergies, and providing nut-containing products may cause severe allergic reactions in other participants. If my child has a nut allergy, I acknowledge that it is impossible to guarantee the complete elimination of nut exposure.

I hereby waive any and all claims against the Company for any exposure to nuts, nut by-products, or products processed in contact with nuts, whether intentional or accidental.

COVID-19
COVID-19 has been declared a worldwide pandemic by the World Health Organization. It is highly contagious and primarily spreads through person-to-person contact. MOA Art Kids art studios have implemented preventive measures, following local and national health guidelines, to minimize the risk of infection, including:

  • Screening for COVID-19 symptoms;
  • Implementing physical distancing measures where applicable;
  • Regular and frequent cleaning of equipment and high-touch surfaces;
  • Providing signage and information to help prevent the spread of COVID-19.

While we strive to maintain a safe and clean environment, MOA Art Kids art studios cannot guarantee that you or your child will not be exposed to or infected by COVID-19. Attending our facility may increase your and your child’s risk of contracting COVID-19.

By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child and/or I may be exposed to or infected by COVID-19 while attending the art programs at MOA Art Kids. Such exposure or infection could result in personal injury, illness, permanent disability, or death.

Responsibility for Property
Students, their parents, guardians, and accompanying individuals are responsible for safeguarding the property of the Company, as well as the facilities, staff, clients, and associates of Regus Offices. Participants must maintain the cleanliness of the building, studio, and common areas and take care to prevent any damage, loss, or misplacement of property.

In the event of accidental or intentional damage, loss, or misplacement of property, students and their guardians will assume full financial responsibility for the cost of repair or replacement.

Personal Property
All personal property belonging to students, parents, guardians, or accompanying individuals is the sole responsibility of its owner. The Company is not liable for any damage, theft, or loss of personal property while on the premises.

Photography and Media Release
At MOA Art Kids, we may occasionally photograph participants or their artwork for use in our marketing materials, including print, web, or social media. Photographs will focus on unidentifiable views of participants and/or full views of their artwork, ensuring that the face or identifiable likeness of any child or youth is not captured or shared without express consent from a parent or guardian.

For example, we may take a photo over a child's shoulder as they draw or paint, or ask a child to hold up their artwork to obscure their face. If a child or youth declines to participate in such photos, their choice will be fully respected.

By enrolling in MOA Art Kids classes, parents/guardians grant permission for the Company to photograph or record videos of students and their artwork during classes. These materials may be used for promotional purposes on the Company’s website, social media, or other marketing platforms. Students will not be identified by name in these images without explicit consent.

If you prefer that your child, not be included in any group photos or media, please notify us in writing prior to the start of classes. All photographs and videos remain the property of the Company and may not be published by third parties without permission.

Privacy and Information Handling
MOA Art Kids is dedicated to protecting personal information by adhering to responsible information-handling practices. We collect and use the information you provide when accessing or registering for a program to better meet your service needs, ensure a safe environment, conduct statistical and program assessments, inform you about the program in which you are registered, and comply with government and regulatory requirements.

Occasionally, you may receive updates about other art programs, services, and opportunities that may interest or benefit you.

We do not share your personal information with any other businesses, except as necessary to process registration transactions through our payment processor. Your personal information will never be sold or disclosed to third parties outside of these specific purposes.

All Sales Final
Fees for classes, workshops, camps, and feedback sessions are due in full at the time of booking. Withdrawal requests must be submitted in writing via email to info@moaartstudios.com.

All art program fees are non-refundable unless MOA Art Kids cancels a program or class due to unforeseen circumstances such as weather, health issues, emergencies, or low enrollment. In such cases, clients will be notified promptly and offered a choice between a full refund or credit for future classes.

Credit and Withdrawal

  • Credit: Credit will be issued for fees paid if a withdrawal request is made more than 7 days prior to the first day of the class, workshop, or camp.
  • Refunds: Refunds are available upon request for withdrawals made more than 7 days prior to the first day of the class, workshop or camp, minus a $30 administration fee. Withdrawals made on or within 7 days of the class or workshop start date are not eligible for credit or refunds for any reason.

Credit can be applied toward the fees of any participant for classes, workshops, camps, or similar services offered by MOA Art Kids.

Drop-Off and Pick-Up
MOA Art Kids is not responsible for any child dropped off outside the studio without proper supervision. Parents or guardians must accompany their child into the studio and ensure they are dropped off only when MOA Art Kids staff or designated personnel are present.

MOA Art Kids is not liable for children who are dropped off early, left unsupervised, or allowed to walk to or from the studio without prior arrangements. If a child is permitted to walk home after class, parents or guardians must notify the instructor in advance, either through email or text message.
